It seems Elon Musk is courting chaos again, with his latest AI venture, Grok, stirring a legal hornet’s nest. Grok’s knack for generating eerily accurate images of celebrities has landed Musk and X (formerly Twitter) in hot water, with critics accusing the billionaire of playing fast and loose with dangerous deep fakes – where AI is used to create videos or images of real people – and image rights.

“Fair use” or foul play?

Grok’s image generation relies on a controversial data source- millions of photos uploaded to X by unsuspecting users. While Musk claims the practice falls under “fair use,” this legal grey area is distinctly American and has no counterpart in Europe. European courts, already sharpening their legal knives over X’s violations of the Digital Services Act, are unlikely to look kindly on this.

Scarlett Johansson speaks out: X-rated lawsuits on the horizon?

Hollywood superstar Scarlett Johansson is one of the many celebrities raising red flags. She’s already fought battles over AI mimicking her voice, forcing OpenAI to backtrack on similar claims. With Grok’s images resembling the real deal, it seems Musk is inviting an even bigger showdown.

While Grok’s terms of service insist users are responsible for any misuse, experts say that won’t stop lawsuits. Legal experts point out that illegal images – AI-made or hand-drawn – are still illegal. Whether it’s defamation or exploiting someone’s likeness for profit, the buck stops with the publisher, not the tech.

Europe eyes mega-fines

As if that weren’t enough, the EU is breathing down Musk’s neck with a potential multimillion-euro fine for breaches of its stringent digital laws. With the likes of Google and Microsoft pledging compliance, Musk’s maverick approach to rules could cost him dearly.

Celeb cash cow or legal liability?

For now, no celebrity lawsuits have landed on Musk’s desk, but the storm clouds are gathering. Legal eagles predict high-profile cases are only a matter of time, particularly in Europe, where image rights are arguably taken far more seriously.

Musk’s long game

Elon’s strategy appears clear – keep pushing boundaries until the courts catch up. With Grok producing results unmatched by competitors, Musk is banking on a lengthy legal process allowing him to dominate the AI image generation market.

The bottom line

While Musk’s ‘ask forgiveness, not permission’ mantra has brought him success in the past, Grok’s foray into celebrity deepfakes could be his riskiest gamble yet. Whether he’s a genius innovator or a reckless rebel, this legal saga is just getting started.
